Terms of use
The agreement between you and Kinly. The most important part is section 3, which sets out what Kinly cannot promise.
1. Who these terms are with
Kinly is provided by Apex Tracking Group Ltd, a company registered in England and Wales under company number COMPANY_NUMBER_TO_BE_CONFIRMED, whose registered office is at REGISTERED_OFFICE_TO_BE_CONFIRMED (“we”, “us”). By creating an account or using the app, you agree to these terms.
How your data is handled is set out separately in the privacy policy, which forms part of these terms.
2. What Kinly is
Kinly is an app that lets you nominate a small group of people you trust — your Circle — and alert all of them at once, with your live location, by pressing one button.
That is the whole of it. Kinly is a way of telling people something is wrong. What happens next is between you and them.
3. What Kinly does not promise
Please read this section properly. It describes the limits of what this app can do, and those limits are real.
- Kinly is not an emergency service and is not a replacement for one. It does not contact the police, the ambulance service, or the fire service. It does not pass your details to anyone in authority. If you are in danger, call 999.
- Kinly cannot guarantee that anyone answers. The people in your Circle are private individuals with their own lives. They may be asleep, on a train, out of signal, or unable to help. Kinly sends the alert; it cannot make anybody act on it.
- Kinly cannot guarantee that an alert is delivered. Delivery depends on your phone, your battery, your network, the recipients’ phones and their notification settings, and on Apple’s and Google’s notification services. Any of those can fail, and some of them are outside anyone’s control.
- Kinly cannot guarantee that your location is accurate. Satellite positioning is approximate, worse indoors and underground, and may be unavailable entirely. If your phone cannot get a fix, the alert is still sent — without a location.
- Kinly should not be the only safety measure you rely on. Treat it as one thing among several, not as a substitute for leaving, telling someone where you are going, or calling 999.
4. Who can use Kinly
You must be at least 13 years old to have a Kinly account. If you are under 18, you should talk to a parent or guardian before setting one up, and it is sensible for them to be in your Circle.
Kinly has no guardian accounts and no parental controls. Everyone has the same kind of account, and no account can monitor another.
5. Your account
- Give a real name, or at least one the people in your Circle will recognise. In an emergency, a name nobody knows is not useful.
- Keep your sign-in details to yourself. One account belongs to one person.
- Tell us at support@kinly.help if you think someone else has access to your account.
6. Your Circle
- Nobody joins your Circle, and you join nobody else’s, without an invitation being sent and accepted. Membership is never automatic.
- Being in someone’s Circle does not put them in yours. The two are separate, and either can exist without the other.
- You can remove anyone from your Circle, and leave anyone else’s, at any time and without giving a reason. You do not need their agreement, and they are not asked to approve it.
- Only invite people who would want to be told. An alert is a serious thing to send somebody.
7. Acceptable use
You agree not to:
- Send alerts you do not mean. False alarms frighten people and make the real ones count for less.
- Use Kinly to harass, frighten, coerce or keep track of anybody. Pressuring someone into joining your Circle, or into staying in it, is a misuse of this app.
- Create an account for somebody else, or in somebody else’s name.
- Attempt to access data that is not yours, interfere with the service, or work around its security.
Kinly limits how many alerts one account can send in an hour. This is to stop the app being used to flood someone with notifications. It never blocks a first alert.
8. Availability
Kinly is provided as it is. We work to keep it running and to fix things that break, but we do not promise it will be available without interruption, and it may be unavailable during maintenance or because of a failure at one of the services it depends on.
Kinly may change over time. Features may be added, altered or withdrawn. If a change materially reduces what the app does for you, you will be told.
9. What it costs
Kinly is free to use. There is no charge, no subscription and no paid tier, and no feature is withheld from anyone on the basis of payment.
If that ever changes, existing users will be told well in advance, and no charge will be made without your agreement. You will never be billed for something you did not agree to pay for, and Kinly will not begin charging for a feature you were already relying on.
Kinly may at some point invite voluntary contributions towards its running costs. Anything of that kind is a gift and not a purchase: it buys no feature, no priority and no different version of the app, and choosing not to give changes nothing about the service you receive.
10. Ending your use of Kinly
You can delete your account at any time, from Settings in the app or by requesting it here. What that deletes, and what it does not, is set out in the privacy policy.
We may suspend or close an account that is being used to harass somebody, to send deliberate false alarms, or in breach of section 7. Where it is possible and appropriate, you will be told why and given a chance to respond.
11. Our responsibility to you
Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, you keep all of your statutory rights, and nothing here affects them.
Beyond that:
- Kinly is not responsible for what the people in your Circle do or do not do. They are not our agents, employees or representatives, and we have no control over whether they respond.
- Kinly is not responsible for a failure caused by something outside our reasonable control — your phone, your battery, network coverage, a mobile operator, or Apple’s or Google’s notification services.
- Kinly is not liable for loss that was not reasonably foreseeable at the time you started using it.
Please read section 3 alongside this one. Kinly is free, it is one tool among several, and it should never be the only thing standing between you and harm.
12. Changes to these terms
These terms may change. If a change matters to you, the date at the top changes and you will be told in the app before it takes effect. Continuing to use Kinly after that means you accept the new version. This version is in effect from 23 September 2026.
13. Governing law
These terms are governed by the law of England and Wales, and disputes may be brought in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your own courts.
